Professional / Academic History

Kok Peng became a Principal Partner of Braddell Brothers in September 2009 and was of the prime movers in the rejuvenation of Braddell Brothers.

A top student in school, Kok Peng was consistently on the Dean's List at the Faculty of Law, National University of Singapore ("NUS") where he graduated with honours in 2000.

Beyond textbooks, Kok Peng honed his legal craft in mooting competitions. In 1997, Kok Peng won the B.A. Mallal Moots as a Second Year undergraduate. He also represented NUS in the prestigious Philip C. Jessup International Law Moot Court Competition in 1999 and the Manfred Lachs Space Law Moot Court Competition in 2000. In the latter, he was awarded the Best Orallist award in the Asia-Pacific Regional Round of the competition held in Sydney, Australia.

Upon graduation, Kok Peng began his legal career at Drew & Napier as a pupil of one of Singapore's top Senior Counsel. He went on to practice at Drew & Napier LLC for the next five years, handling a variety of complex and challenging litigation matters.

In 2002, he was seconded by Drew & Napier LLC to the London office of their then joint law venture partner - Freshfields Bruckhaus Deringer (one of the world's largest international law practices) - where he gained invaluable experience working on multi-jurisdictional disputes.

In 2006, Kok Peng joined the Hongkong and Shanghai Banking Corporation Limited as Legal Counsel advising their corporate trusts and loans agency, custody and trust/funds services as well as insurance businesses. Kok Peng also advised HSBC's Singapore branch on their outsourcing and corporate support requirements. Beyond providing legal advice to the business, Kok Peng was frequently called upon to assist in direct negotiations with key partners and clients.

After about two years with HSBC, Kok Peng returned to private practice, initially as a Director with Tan Peng Chin LLC, before joining Braddell Brothers as a Principal Partner.

Areas of Practice

Kok Peng's practice encompasses a wide spectrum of civil and commercial disputes involving contracts for the sale of goods and shares, shareholders' disputes, directors' duties and liabilities and employment matters. From his time as legal counsel to one of the world's leading financial institutions, Kok Peng has gained an insider's insight into the operations of the financial industry. He combines this with a keen understanding of complex financial products and structures to his advantage in handling financial services industry disputes.

Professional Highlights

Some of the more significant cases that Kok Peng has been involved in, include:-
  • Acting for a long-established local company in recovering some of Singapore's most recognisable trademarks including many household names.

  • Acting for one of the world's most established private banks in defending claims made by a former customer for misrepresentation, breach of mandate, breach of contract, breach of fiduciary duties, also involving a claim arising out of the imposition of foreign exchange control measures by the Malaysian Government in 1998.

  • Acting for the sovereign of a neighbouring country in establishing beneficial ownership of property designated as "State Property".

  • Acting for the government of a South Asian nation in upholding an arbitral award.

  • Acting for a listed company in defending a wrongful dismissal claim by a former senior executive who also filed a counterclaim for breach of contract.

  • Advising creditors of China Aviation Oil Corporation (Singapore) Limited ("CAO") in negotiating a settlement as CAO sought to put in place a scheme of arrangement.

  • Advising a substantial shareholder of a listed company in fending off a hostile takeover by another substantial shareholder.

  • Advising a minority shareholder in a joint-venture with a private equity fund on an exit strategy.

  • Advising the owners of a major shopping-cum-office complex on recovering damages from a government authority for breach of contract.

  • Advising the board of a listed company in managing the termination of its Chief Executive Officer.
